Terms of Use & Cancellation Policy
Last updated:
Welcome to HappyDays (ימים שמחים) at happy-days.co.il (the "Site" or the "Service"). By using the Site, registering, purchasing a package or activating an event you agree to the terms below and to the Site's privacy policy, which appears on a separate page and forms an integral part of them. Please read them carefully.
1. The service
The Site is an interactive platform for a countdown to an event (a wedding, birthday, anniversary and more) built from digital "locks": the organizer sets up a series of locks that open at pre-set times, each holding a greeting, riddle, photo, video or audio.
"Organizer" — whoever registers, creates the event and pays for it. "Celebrant" — the person the event is made for, who views it through a unique link without registering.
2. Your account
- You register with an email address and a password. Please provide accurate, up-to-date details.
- The organizer is responsible for keeping the password confidential and for all activity in the account.
- The organizer is responsible for providing the celebrant's email address with their consent, and for the event only.
3. Prices and payment
- Package prices are shown on the Site in Israeli shekels and include all charges.
- Payment is made by Bit or bank transfer, using the details on the payment page. Please write the email address you registered with in the transfer note.
- The event is activated once the transfer has been received and approved, or immediately when a coupon covers the full amount. A discount coupon is valid under its terms and can be used once per user.
- Upgrading a package costs only the difference between the new package and the amount already paid. Moving to a cheaper package does not entitle you to a refund.
4. Cancellations and refunds
The Service is a digital product personalised for the event and the organizer, consisting mainly of supplying "information" as defined in the Israeli Computers Law, 5755-1995, and available for immediate use once activated. Therefore, in line with the exceptions to the right to cancel a distance sale set out in the Israeli Consumer Protection Law, 5741-1981, once an event has been created and activated — the payment completed or a coupon redeemed — no refund is given for cancelling the purchase.
This does not derogate from any right that cannot be waived by law. A double or mistaken charge is refunded in full. If a material technical fault on our side prevented the use of the event, we will review the request on its merits and may grant a full or partial refund at our discretion.
Send payment and refund requests through the contact form, with your account email and the event name. An approved refund is made to the payment method used (Bit, or the bank account the money came from); once made, the event is cancelled and the celebrant's link stops working.
5. Content users upload — the organizer's responsibility
- The organizer declares that every photo, video, audio file, document or text they upload is fully owned by them or used under a valid licence, and that they hold all required consents — including those of people pictured or recorded, and rights to music and videos.
- The organizer bears sole responsibility for the content they upload and for any consequence of its use, and will indemnify the Site's operator for any claim, damage or expense caused by such content or by a breach of these terms.
- Content remains the organizer's. They grant the Site permission to store it and show it to the celebrant solely to provide the Service, until it is deleted (see the privacy policy).
- Offensive, threatening, misleading or unlawful content, or content infringing others' rights, is not allowed. We may remove such content and block accounts that breach these terms, without refund.
6. Notice and takedown — copyright infringement
If you believe content on the Site infringes your copyright or another right of yours, please contact us at hadasm293@gmail.com or through the contact form, stating: your name and contact details; the work or right you claim was infringed; the event link or an exact description of the infringing content; and a statement that the notice is made in good faith and its details are accurate.
We review every notice promptly. Where the claim appears well-founded, we remove the content or block access to it within a reasonable time, and inform the organizer who uploaded it, who may respond.
7. Availability and limitation of liability
- The Service is provided "as is". We make reasonable efforts to keep it running smoothly, but interruptions, errors or delays may occur.
- The Site's operator is not responsible for disruptions, blocking or delays caused by internet-filtering software or services used by the user or the celebrant (such as NetFree, Rimon and the like), by their device, browser or network settings, or by email filtering (including mail landing in spam).
- The Site's operator is not responsible for faults, outages or data loss originating with third-party providers the Site relies on — including cloud, storage and hosting providers, email services and YouTube.
- Every event and all its files are kept on the Site until 14 days after the event date, then permanently deleted. Until then you can download the souvenir album (PDF), the audio files and the videos — and we recommend keeping a copy of any important content.
- To the fullest extent permitted by law, our liability for any damage is limited to the amount paid for the relevant event.
8. Privacy
How information is collected, used, kept and deleted is set out in the Site's privacy policy, on the "Privacy Policy" page (linked at the bottom of every page).
9. Changes
We may update these terms from time to time. The binding version is the one on this page; the last update date appears at the top.
10. Governing law and jurisdiction
These terms and the use of the Site are governed solely by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction over any related matter.
11. Site operator and contact
The Site is operated by Hadas Metzger (the "operator"). For any question or request, write to us through the contact form; legal notices (such as an infringement notice) can also be sent to hadasm293@gmail.com.
